Since no one understands the process and most homeowners start from the position that there’s nothing you can do about it, they don’t challenge those assessments. Business owners who are paying millions of yen a year for property taxes can afford to hire expensive consultants to check their tax assessments, but residential property owners can’t, and if they’re only paying ￥100,000, they probably don’t think it’s necessary.

Another aspect of property taxes that we didn’t go into is that local governments, and even the central government, manipulate them in order to carry out stimulus programs. Right now, in fact, the central government allows for up to a 50 percent cut in property taxes for people who buy new homes that fit certain criteria having to do with energy savings. We didn’t mention it in the article because the tax cut expires in March, which means you would have to close on a house before then to take advantage of it. But it might be extended. They can collect more taxes from the operators. It’s not just a question of jobs.

After just over three years on the market and at the center of a heated legal dispute between two prominent local Lake Oswego residents, one of the most expensive residential properties listed in Oregon has yet to sell.

Jerry Stubblefield, the founder of Avia footwear, wants off the only island estate on Oswego Lake, but for $15 million, the 13,500-square-foot home has been a tough sell.

Justin Harnish, real estate broker of Harnish Properties who is marketing Stubblefield’s property, declined to comment on the listing. Other agents said the market for lakefront Lake Oswego property can be fickle.

“It’s not just an expensive home, it’s a grand lake estate,” said Mary Jo Avery, a Lake Oswego-based real estate agent with RE/MAX equity group. “But at the same time, it is a very, very high-end property, and the right buyer seems like it’s been hard to find.”

In her most recent cases this year, she had one property on Oswego Lake sell in one day for $2.3 million, but it took eight months to sell another property listed at about $2 million.

Avery said she’s interested in how a nearby property fares, a five-bedroom, 13,462-square-foot home built near Stubblefield’s property in 2009 at 1500 Northshore Rd. That property went up for sale about a month ago for $11.6 million.

“When you get above the $4 million-$5 million price range, you’re usually in it for the long haul,” Avery said.

Stubblefield’s 5-acre island estate was originally built in 1929 for Carl Jantzen, a founder of the Portland Knitting Mills, which later became Jantzen Swimwear. As a result, the property has been referred to as Jantzen Island.
Stubblefield, 71, said in 2008 that he bought the island in 1987 for $2.2 million in cash. He would go on to spend another $5 million remodeling the home and grounds in 1987 and 1988. A gate-secured private bridge leads to the estate, which includes a residence with four bedrooms and six baths, a six-car garage, pool, sauna, boathouse and dock, as well as a separate living quarters.

The property went on the market in Sept. 2008 for $19.5 million. The listing price was lowered to $15 million in April 2010.

The island estate has attracted some interest from buyers in recent years, including from Lake Oswego Councilor Mike Kehoe who made an offer of around $7 million in the summer of 2009. However, he later withdrew the offer.

The home has been the centerpiece of an ongoing legal battle between Stubblefield and former Oregon gubernatorial candidate, Chris Dudley.

Dudley lent Stubblefield $3.75 million in June 2009 to help save the Avia founder’s Oswego Lake home. The 18-month loan was granted by Dudley’s company, Tesoros de Oswego, and Stubblefield put his island home up as collateral, agreeing to repay the loan by December 2010.

Stubblefield filed a million-dollar lawsuit against Dudley, 46, in May alleging the former Portland Trail Blazer tried to change the terms of their agreement and collect an extra $1 million. According to their contract, Stubblefield was to repay the debt on Dec. 1, 2010, with a 10-day grace period. The contract calls for a pre-payment penalty of $1 million, but the two sides disagree on what triggers the penalty.

Stubblefield asserts that when he offered to pay off the loan, Dudley refused to accept it, allowing the deadline to pass and putting Stubblefield in default of the loan.

Dudley claims when Stubblefield attempted to pay the loan on Dec. 8 without including the $1 million penalty, he did not pay the full amount and put himself in default.

A Clackamas County court judge granted a preliminary injunction on Sept. 8, stopping a non-judicial foreclosure of the property set by Dudley for later that month. At that point, Dudley alleged the debt, with accrued interest, had grown to around $5.4 million.

Dudley’s attorneys have asked for a summary judgment hearing on Jan. 23, 2012. A trial date has been set for April 10, 2012.

An August appraisal report paid for by Stubblefield lists the property’s value at $12 million. Clackamas County records indicate the island’s value is closer to $8.2 million. Dudley’s attorneys maintain the value hovers around $7 million.

Steve Thoele, a broker with Keller Williams Realty in Portland, said although he hadn’t kept up with the legal proceedings involving the island property, he guessed that they may play some part in it not selling.

“And there are very few buyers in the Portland market that could buy a property for $15 million,” he said. “That’s for sure.”
